A Mavoko court has ordered the detention of advocate Angela Mulwa, daughter of Rose Mbithe Mulwa (also known as Rose Mbithe Ndetei), for 14 days. This decision comes amid ongoing investigations into the murder of Dr. Victoria Nthunya Mutiso, where Angela has been identified as a person of interest.
Magistrate Lilian Nyabando has also detained another person of interest, Nelson Masiga Makaralu, to facilitate the Directorate of Criminal Investigation (DCI) in completing its inquiries regarding the theft of motor vehicles belonging to the deceased.
On Monday, August 3, 2026, DCI officer Gilbert Okello, assigned to DCI Athi River East Mlolongo, requested a 21-day detention for both individuals to allow for thorough investigations into the stolen vehicles.
In her ruling on Tuesday, August 4, 2026, Magistrate Nyabando approved the State’s application, emphasizing the necessity of the detention for the DCI to finalize its investigations effectively and efficiently.
The court has instructed that during this period, Investigating Officer Okello must pursue the investigations diligently and without unnecessary delay, underscoring that the detention is specifically for this purpose.
“The prosecution’s applications partially succeed; Angela Mulwa and Nelson Masiga will remain in lawful police custody for 14 days from today to facilitate the completion of the specified investigations,” Magistrate Nyabando stated.
“To clarify, the court stresses that these custodial orders do not imply a finding of guilt. The respondents retain the presumption of innocence as guaranteed under Article 52A of the Constitution,” the magistrate further noted.
In a related investigation, the DCI is probing a case concerning the forgery of a land title document, fraudulent eviction, demolition, and the theft of two motor vehicles: a Range Rover Sport (Registration No. KDU 799Y) and a Toyota Prado TX (Registration No. KBT 935T).
The DCI reports that of the four stolen vehicles, two belong to the Africa Institute of Mental and Brain Health (AFRIMEB), while the others belong to Professor David Musyimi Ndetei, including a Toyota pickup (Registration No. KAK 225K) and a Toyota Corolla (Registration No. KAN 506B).
The application indicates that the late Dr. Victoria Mutiso reported the matter on May 4, 2026, stating that their matrimonial home in Mlolongo was raided, demolished, and valuable items, including a black Range Rover Sport valued at Ksh15,000,000, were stolen. This vehicle was later recovered at Angela Mulwa’s premises, where both Angela and Nelson were found in possession of it.
“The first two vehicles, KDU 799Y and KBT 935T, are owned by AFRIMEB, an institution co-founded by the complainants, Professor David Musyimi Ndetei and his late wife, Dr. Victoria Mutiso, who tragically lost her life on July 29, 2026. This case is actively under investigation by our Homicide Team at DCI Headquarters Nairobi, which has already arraigned two suspects before the Milimani Law Courts on murder charges,” part of the application reads.
The State asserts that in connection with the murder case, Angela and Nelson must undergo forensic digital identification, which includes reviewing CCTV footage and their communication networks. Additionally, Rose Mulwa and Chris Mulwa are also persons of interest in Dr. Mutiso’s murder and face murder charges.
The DCI highlights that the families of Professor Ndetei and the late Dr. Mutiso have endured significant losses due to unlawful eviction and the demolition of their properties, valued at approximately Ksh1,500,000,000, compounded by the tragic execution of Dr. Mutiso related to a land matter currently under investigation by DCI Mlolongo. Angela and Nelson are persons of interest, having been found with one of the stolen vehicles from the site of the demolition.
The case is set to be mentioned again on August 19, 2026.
