
The Ethics and Anti-Corruption Commission (EACC) successfully dismissed five applications from Kiambu Governor Kimani Wamatangi and other defendants who aimed to strike down its suit for recovering Ksh 813.1 million tied to alleged irregularities in road tender awards.
This case involves payments made to five companies for road contracts granted by the Kenya Urban Roads Authority (KURA), Kenya Rural Roads Authority (KeRRA), and Kenya National Highways Authority (KeNHA).
The EACC claims that Wamatangi, during his tenure as a Senator, leveraged his position to influence tender awards to companies where he had a beneficial interest, utilizing forged or falsified documents to secure these contracts.
The Commission seeks to recover Ksh 813,145,532.40 from the defendants collectively, along with the forfeiture of funds held in the companies’ bank accounts.
In her ruling on October 1, 2026, High Court Judge Rose Ougo stated that the allegations of fraud, misrepresentation, and document falsification must undergo a thorough examination in a full hearing. The determination of whether the company directors can be held personally liable will also be addressed during this process.
The Court further clarified that parliamentary privilege does not protect alleged unlawful actions, and Governor Wamatangi failed to demonstrate that the recovery suit overlaps with issues in his pending constitutional petition.
The recovery suit will move forward to a hearing.
