The high court today dismissed with cost an application that was made by Kirinyaga governor Ann Waiguru. The governor had gone to seek the opinion of the court regarding her recent impeachment.
Kirinyaga members of county assembly ignored the previous court order and proceeded to impeach her, a move that the governor protested with hope of seeking reprieve from the high court.
Through her lawyers, madam Waiguru argued that the members of the county assembly had violated a court order that had stopped any of such motion(s) against her until the issues raised before the court were addressed.
However, justice Weldon Korir ruled that the MCAs did not violate any court order or law by impeaching her since they were performing their oversight roles as enshrined in the constitution.
The latest court decision is a big blow to the governor and her fate now lies with the senators who will further debate the merits of the impeachment.Whether she will appeal the current court decision remains a story for another day.
