Kenyan man Felix Kibet sues X for hate speech and violence

Kenyan petitioner Felix Kibet has filed a lawsuit against X, formerly known as Twitter, claiming the platform enables hate speech, incitement to violence, and societal harm.

Kibet argues that X’s lack of content regulation violates Kenya’s 2010 Constitution by undermining individual rights and public morality.

In his petition, Kibet contends that the platform facilitates the publication of content that disrespects the rights and reputations of individuals. He asserts that X’s failure to regulate offensive material has created a breeding ground for societal harm. “The petitioner avers that the 1st respondent (X) allows, encourages, and promotes harmful content on its platform, which contravenes Articles 10 and 19 (3) of the Constitution,” the petition states.

Kibet also highlights the issue of anonymous accounts, claiming they amplify misuse and impersonation on the platform. He has requested a court order compelling X to delete offensive content, suspend anonymous accounts, and enforce stricter oversight of services like Spaces.

High Court Judge Bahati Mwamuye has certified the case as urgent, with a hearing scheduled for January 17, 2025. Kibet seeks a permanent injunction against X, aiming to prevent the publication of harmful content, including hate speech and pornography.
