Gachagua Can Still Run for President: Lawyer Peter Wanyama

Advocate Peter Wanyama confidently asserts that former Deputy President Rigathi Gachagua can still run for the presidency, despite a recent High Court setback in his impeachment case.

On his official X account, Wanyama emphasized that the legal process continues, and Gachagua’s political fate ultimately lies with the Supreme Court. He stated, “The Constitution provides strong protections for Gachagua’s rights, and his eligibility remains intact until all appeals are resolved.”

Wanyama noted that while Gachagua faced challenges at the High Court, his rights are safeguarded until the Supreme Court makes a final ruling. He stressed that Kenyan law does not automatically disqualify candidates from elections during ongoing judicial processes.

He urged supporters and critics alike to refrain from jumping to conclusions based on the High Court ruling, reminding everyone that the legal journey is far from over. “It’s premature to celebrate or despair over the High Court’s decision; this process is just beginning,” Wanyama said.

The High Court recently upheld Gachagua’s impeachment but awarded him Ksh50 million in damages for a fair hearing violation. The court found that while the impeachment met constitutional standards, the process lacked fairness due to ignored medical adjournment requests.

Gachagua’s team is poised to pursue further legal avenues as the case moves forward. Kirinyaga Woman Representative Njeri Maina expressed disappointment with the ruling and confirmed plans to appeal at the Court of Appeal. She reassured supporters to remain calm during this legal process, stating, “He’s a peace-loving Kenyan and calls for patience as we navigate this judgment.”

The ruling was delivered by Justices Eric Ogola, Anthony Mrima, and Freda Mugambi.
