Court nullifies the election of two ODM legislators

The High Court on Friday 3rd March nullified the 2022 election election two Orange Democratic Movement (ODM) legislators.

The Members of Parliament for Lagdera MP Hon. Abdikadir Hussein and his Magarini counterpart Hon. Harrison Kombe suffered setbacks after a successful petitions by UDA’s Abdiqani Zeitun and UDA candidate Stanley Kenga respectively.

Malindi High Court Judge Justice Alfred Mabeya annulled the election of Magarini MP Harrison Garama Kombe on grounds of irregularities such as vote stuffing and inconsistencies between the total number of votes tallied and votes captured on ballot papers. 

On the other hand, the High Court in Garissa annulled the election of Lagdera MP Abdikadir Hussein, citing irregularities too.  According to the election results declared by the Independent Electoral and Boundaries Commission, Hussein garnered 5,939 votes to clinch the seat ahead of United Democratic Alliance’s- UDA’s Abdiqani Zeitun who had 4,863 votes.

Hussein’s competitor in the August 2022 polls,  Zeitun, had moved to the court to challenge Hussein’s win in the hotly contested race.  In February, the court ordered a recount of Lagdera Constituency votes that revealed widespread discrepancies in the election petition challenging the declaration of Mohamed as the victor.
