Sirisia Member of Parliament Hon. John Waluke has been sent to jail for 67 years after being found guilty in the 297 million maize fraud scandal.
In a ruling issued today by Anti Corruption court judge Elizabeth Juma, the MP and his co accused have been given the option of paying Kshs. 1 billion to avoid going to jail for defrauding the National Cereals and Produce Board (NCPB) Ksh.313 million.
Charged alongside the MP was Ms Grace Sarapay Wakhungu, who was ordered to pay a fine of Kshs. 1 billion or face a 69-year jail term and Erad Supplies & General Contracts Limited (Erad); a company where the two are shareholders.
According to the charges, Waluke and Wakhungu, through Erad Supplies were supposed to supply 40,000 metric tonnes of maize to NCPB in 2004 but ended up pocketing Ksh.313 million without any supplies.
The tender was later on cancelled after Erad Supplies, failed to prove it had sufficient funds to supply the maize.
The ruling is the first major win by the judiciary in the fight against corruption with pundits saying that the judiciary is finally getting its act together.
According to Lawyer Steve Ogolla, Waluke has lost his parliamentary seat within the meaning of Justice Mumbi Ngugi’s guidelines, rulings and articles 73 (1) (a) (iv), 103(1)(b) and 104(1) of the Constitution.
