Why Lawyer Nelson Havi wants Chief Justice Martha Koome to resign

Lawyer Nelson Havi has publicly called for Chief Justice Martha Koome to resign, igniting a heated debate within Kenya’s judiciary. Speaking on Citizen TV on Wednesday morning, Havi says Koome has to step down for abetting absenteeism by judges amongst other things.

This demand comes as Koome faces intensified scrutiny and criticism, particularly regarding allegations of corruption within the judiciary.

However during the High Court Annual Human Rights Summit on December 10, 2024, Chief Justice Koome addressed the growing calls for her resignation, asserting that she will not be intimidated into stepping down. She described herself as a victim of cyberbullying, which she characterized as a form of technologically facilitated Gender-Based Violence (GBV) aimed at disrupting her leadership.

“I’m a victim of cyberbullying… intended to scare me, disrupt me, to defame me and haunt me out of office, but they can try something else,” she stated, emphasizing her determination to remain in her position.

Koome also praised the High Court for its role in defending the rights to assemble and protest, highlighting the court’s efforts in promoting good governance and democracy. She acknowledged the significant achievements of the judiciary while recognizing the ongoing human rights challenges that Kenya faces.

The controversy surrounding Koome intensified following allegations made by Senior Counsel Ahmednasir Abdullahi, who accused unnamed judges and intermediaries of accepting bribes to influence judicial outcomes. Although Koome acknowledged these accusations, she noted the lack of specific details, such as the identities of those involved.

In response to the allegations, Koome directed the Secretary of the Judicial Service Commission (JSC) to initiate an investigation and encouraged Abdullahi to cooperate. However, Havi has stated that he will not participate in any investigation unless it includes a review of Koome’s actions.

As the situation unfolds, the pressure on Chief Justice Koome continues to mount, raising questions about the future of leadership within Kenya’s judiciary. Her commitment to transparency and accountability will be crucial as she navigates these tumultuous waters.
