Undeterred by impeachment, Gachagua eyes 2027 election

Former Deputy President Rigathi Gachagua has reaffirmed his determination to pursue political office in the upcoming 2027 General Election, despite his impeachment last year.

In a recent interview with Musyi FM, Gachagua stated that he has not yet exhausted all legal options to appeal his impeachment and seek redress.

Gachagua expressed confidence that his political standing and ability to rally support remain intact. He drew parallels to past political figures, noting that both President Uhuru Kenyatta and Deputy President William Ruto faced serious legal challenges during their candidacies in 2013, yet still managed to win their positions. “The Kenyan Constitution is clear: no one can be barred from vying for office simply because they have a case in court,” he asserted.

With a renewed focus on his political ambitions, Gachagua emphasized that his current circumstances allow him ample time to strategize. “I have time to plan Kenya’s politics. I am not raising children or farming; I am here to strategize on how we will rescue our country,” he remarked.

However, it’s important to note that under Kenyan law, individuals who have been impeached and removed from office are prohibited from holding any public or state office unless their impeachment is overturned through legal appeals. Article 75(3) of the Kenyan Constitution stipulates that a person removed from office due to violations of Chapter Six, which addresses leadership and integrity, is disqualified from future state positions.

Moreover, Article 99(2)(h) bars individuals from being elected as Members of Parliament if they have misused public office or violated Chapter Six. Article 99(3) further clarifies that such disqualifications apply only after all avenues for appeal or review have been fully explored.

As Gachagua navigates his political future, the implications of his impeachment will undoubtedly play a significant role in the lead-up to the 2027 elections.
