ODM Constitution Clarifies NDC Notice Rules Amid Sifuna Dispute

Busia County Woman Representative Catherine Omanyo highlighted the Orange Democratic Movement (ODM) Constitution to clarify the process for convening the party’s National Delegates Conference (NDC) scheduled for March 27, 2026.

In her statement on February 22, 2026, Omanyo emphasized that the constitution specifies that the Secretary General must issue the notice and agenda for the NDC at least twenty-one days prior to the meeting. If the Secretary General is unavailable, another official appointed by the National Executive Committee (NEC) can fulfill this role. She also noted that the notice must be published on the party’s website or in a prominent English daily newspaper, as well as broadcast on a leading Swahili radio station.

Omanyo confirmed that the NDC will proceed as planned, adhering to constitutional guidelines. This conference serves as ODM’s highest decision-making body, tasked with addressing critical party matters.

In a related issue, the ODM constitution typically designates the party secretary general, currently Nairobi Senator Edwin Sifuna, to announce the NDC. However, on February 11, 2026, the NEC attempted to remove Sifuna from his position, a decision that the Political Parties Disputes Tribunal (PPDT) subsequently blocked.

The PPDT prevented ODM from publishing the resolution in the Kenya Gazette, which would have formalized Sifuna’s removal. This ruling will remain in effect until the tribunal hears Sifuna’s application contesting his dismissal. Acting PPDT Chairperson Gad Gathu issued a stay on the NEC’s resolution, restraining ODM and the Registrar of Political Parties from any publication related to Sifuna’s removal until further notice.
